1. Assumption of Risk
I, the undersigned, acknowledge that participation in boxing, fitness training, and related activities at Downtown Boxing Gym involves inherent risks, including but not limited to physical injury, muscle strains, fractures, or other conditions related to vigorous physical activity. I am fully aware of the risks associated with these activities and choose to voluntarily participate in them.
2. Health and Medical Condition
I affirm that I am in good health and have no medical or physical conditions that would prevent my participation in boxing and related activities. I understand it is my responsibility to consult with a healthcare provider before engaging in any physical exercise if I am uncertain about my fitness for such activities.
3. Release of Liability
In consideration for being permitted to participate in the activities at Downtown Boxing, I hereby release, waive, and discharge Downtown Boxing Gym, its owners, employees, agents, instructors, and affiliates from any and all liability for personal injury, death, or property damage that may result from my participation in boxing, training, or any other activities at the gym, regardless of whether such injury or damage is caused by the negligence of the gym or any other party.
4. Indemnification
I agree to indemnify, defend, and hold harmless Downtown Boxing Gym, its owners, employees, agents, and affiliates from any claims, liabilities, damages, or expenses (including attorney fees) arising from my participation in activities at the gym, whether caused by my own actions or by the actions of others.
5. Filming and Recording Policy
I acknowledge and agree that Downtown Boxing Gym, its employees, contractors, and agents may take photographs, video, or audio recordings of me during my participation in boxing and fitness activities at the gym. I consent to such recordings and grant Downtown Boxing Gym the right to use these recordings for marketing, promotional, educational, or social media purposes, including but not limited to the gym’s website, social media platforms, and advertisements.
I further understand that these recordings may be made public and may appear on various digital platforms, and I hereby waive any right to inspect or approve the final product. I release Downtown Boxing Gym from any liability or claims related to the use of these recordings.
6. No Refund Policy
I understand and agree that membership fees, class fees, or any other payments made to Downtown Boxing Gym are non-refundable, unless otherwise stated in the gym’s terms and conditions.
7. Governing Law
This waiver and release shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflicts of law principles.
8. Acknowledgment of Understanding
By signing below, I acknowledge that I have read and fully understand the terms of this waiver, that I am voluntarily assuming all risks associated with my participation, and that I am waiving important legal rights.
